Terms of Use

1. Acceptance of Terms

Welcome to FOYOST. By accessing or using the FOYOST website and application (the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.[3]

2. Relationship to Data Sharing Agreement

Your use of FOYOST is also governed by the Data Sharing Agreement (DSA) or Master Service Agreement (MSA) between your School District and WSIPC. In the event of a conflict between these Terms and the DSA, the DSA shall control regarding the handling of Student Data.

3. Eligibility & Authorized Use

  • Authorized Users Only: The Service is intended solely for use by authorized employees and agents of participating School Districts, Educational Service Districts (ESDs), and approved Community Partners.
  • Educational Purpose: You agree to use the data accessible through FOYOST solely for legitimate educational interests, such as strategic planning, counseling, and program evaluation.
  • No Commercial Use: You may not use the Service or the data within it for any commercial purpose, marketing, or sales activity.

4. User Responsibilities

  • Confidentiality: You acknowledge that the Service contains personally identifiable information (PII) protected by federal law (FERPA).[8][9] You agree to keep all data confidential and not to disclose it to unauthorized third parties.
  • Account Security: You are responsible for safeguarding your login credentials. You must notify WSIPC immediately at support@foyost.org of any unauthorized use of your account.
  • No Re-identification: You agree not to attempt to re-identify any de-identified or aggregate data provided through the Service outside of your authorized administrative scope.

5. Intellectual Property

A. The Platform
The FOYOST software, dashboard design, code, and underlying architecture are the proprietary property of WSIPC and its licensors. You are granted a limited, non-exclusive, non-transferable license to access the Service for your District’s internal business use.[10]

B. Global Access & Training Materials
In alignment with our grant obligations to the Bill & Melinda Gates Foundation, all training materials, guidebooks, and strategic planning templates produced for FOYOST are made available under a Creative Commons Attribution 4.0 International License (CC BY 4.0). You are free to share and adapt these specific materials with appropriate credit to WSIPC.

6. Grant-Funded Period & Fees

  • Year 1 (2025-26): Access to the Service is provided at no cost to Washington School Districts through grant funding.
  • Future Fees: Continued use of the Service beyond the grant-funded period (starting August 1, 2026) will be subject to the fees and sustainability model outlined in your District’s renewal agreement.

7. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. While WSIPC strives for accuracy, we make no representations or warranties regarding the accuracy of third-party data sources (specifically the National Student Clearinghouse data). WSIPC disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, WSIPC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to loss of data or service interruptions.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Service interface or via email. Your continued use of the Service constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Washington. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Snohomish County, Washington.
